DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA) POLICY

Totally Reliant Labs (“Company,” “we,” “our,” or “us”) respects the intellectual property rights of others and expects users of our websites, products, programs, services, communities, and digital platforms to do the same.

In accordance with the Digital Millennium Copyright Act (“DMCA”), we will respond promptly to properly submitted notices of alleged copyright infringement involving material hosted on or made available through platforms under our control.

REPORTING COPYRIGHT INFRINGEMENT

If you believe that material available through a website, program, service, community, or digital platform operated by Totally Reliant Labs infringes a copyright that you own or are authorized to enforce, you may submit a written DMCA Notice to our designated agent.

To be effective, your notice must include substantially the following information:

  1. Your physical or electronic signature, or the signature of a person authorized to act on behalf of the owner of the allegedly infringed copyright.

  2. Identification of the copyrighted work you believe has been infringed. If your notice covers multiple copyrighted works located on a single website or platform, you may provide a representative list of those works.

  3. Identification of the material you claim is infringing or is the subject of infringing activity and that you want removed or disabled.

  4. Information reasonably sufficient to allow us to locate the material, including the specific URL or other precise location where it appears.

  5. Information reasonably sufficient to allow us to contact you, including your full name, mailing address, telephone number, and, if available, email address.

  6. A statement that you have a good-faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or the law.

  7. A statement that the information contained in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.

Notices that do not substantially include the required information may be ineffective or may delay our ability to identify, investigate, or respond to the claim.

OUR RESPONSE TO A DMCA NOTICE

After receiving a substantially complete DMCA Notice, we may:

  • Review the notice to determine whether it contains the required information.

  • Remove or disable access to the material identified in the notice.

  • Notify the person who posted or provided the affected material.

  • Provide that person with information about the notice and the counter-notification process.

  • Take any additional action we consider appropriate under applicable law.

Submitting a DMCA Notice does not guarantee that the identified material will be removed. We may request additional information when reasonably necessary to evaluate or process a notice.

COUNTER-NOTIFICATION

If you believe that material you posted or provided was removed or disabled because of a mistake or misidentification, you may submit a written counter-notification to our designated agent.

To be effective, your counter-notification must include substantially the following information:

  • Your physical or electronic signature.

  • Identification of the material that was removed or to which access was disabled.

  • The location where the material appeared before it was removed or access to it was disabled.

  • A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled because of a mistake or misidentification.

  • Your full name, mailing address, and telephone number.

  • A statement that you consent to the jurisdiction of the United States Federal District Court for the judicial district in which your address is located or, if your address is outside the United States, any judicial district in which Totally Reliant Labs may be found.

  • A statement that you will accept service of process from the person who submitted the original DMCA Notice or an agent of that person.

Counter-notifications should be sent to the designated agent listed above with “DMCA Counter-Notification” in the subject line.

After receiving a valid counter-notification, we may forward it to the person who submitted the original DMCA Notice. Unless that person informs our designated agent that they have filed a court action seeking to restrain the alleged infringement, we may restore the removed material or restore access to it no fewer than 10 and no more than 14 business days after receiving the counter-notification, as provided by applicable law.

REPEAT INFRINGERS

In appropriate circumstances, we may suspend or terminate the accounts of users who repeatedly infringe or are repeatedly alleged to have infringed the intellectual property rights of others.

We may also restrict or terminate access to our websites, products, programs, communities, platforms, or services when we reasonably believe a user has repeatedly engaged in copyright infringement or other violations of intellectual property rights.

MISREPRESENTATION

Knowingly and materially misrepresenting that material is infringing or that material was removed or disabled because of a mistake or misidentification may result in legal liability under applicable law.

Before submitting a DMCA Notice or counter-notification, carefully consider whether the disputed use may be authorized by the copyright owner or protected by an exception or limitation to copyright law, including fair use.

CHANGES TO THIS POLICY

We may update this DMCA Policy periodically to reflect changes to our practices, services, or legal obligations. The revised policy will become effective when posted, and the “Last Updated” date at the top of this page will identify the most recent revision.
